Overview
While reading these, please bear in mind that when a sale is made, it is a contract between the Artist and the Buyer. Bird Art International/Artwork International Limited just provides a marketing service.
The Artist's Obligations
The Artist
- must provide accurate detailed descriptions of themselves and their artworks.
- must give exclusive rights to us to sell the artwork for a 3 month period from the approval date.
- warrants that the work of art is original and that they are legally entitled to sell it.
- must provide a local sales tax (GST, VAT) inclusive price for their artwork and provide local postage packaging and insurance cost.
- must pay service fees to Artwork International as soon as they receive monies from the purchaser.
- is liable to pay service charges on any sale to a purchaser introduced to them via this website for a period of 12 months from the date of introduction.
- should note that there is a small withdrawal fee payable if the work of art is withdrawn from the website after 3 months.
- should respond quickly to requests for information about their artworks.
The artist will be sent a copy of the fees schedule when they sign up.
The Purchaser's Obligations
The buyer
- must make full and prompt payment.
- must be aware of border duties and local sales taxes that they may have to pay on importation of goods into a different country.
- in case of a dispute, must deal with the Artist to resolve the issues and keep Artwork International informed.
- if using the Escrow style service, must inform the artist and Artwork International when the goods have been received.
Our Obligations
Artwork International will
- screen all submissions to the website to ensure they meet the required standards.
- pay any monies we have collected on behalf of artists as they fall due.
- produce a monthly newsletter to all people who have requested it.
- actively market the website - through the web and also advertising in appropriate magazines.
- keep artists informed of any changes to fees, terms and condiditons or permitted countries.
- protect your private details (unless required to divulge as a result of a Statutory Declaration)
The fees payable by a customer are based on the fees that are in place on the day of approval of the artwork. We may reduce the fees at our discretion for any reason.

We believe these are fair Terms and Conditions. For example - the reason we ask for a three month exclusive period on each artwork is that we need time to market it and include it on a newsletter. So if there is any part of the conditions you are unhappy with please let us know.
