Buying an Artwork
Once you have found an artwork that you like,
- if you are resident in the same country as the artist- you may select the buy now button.
- or select the enquire button to send them email with your delivery details so they can prepare a shipping quote. This is the only option for overseas or out of state buyers.
See the Escrow style service page for details of the "Buy Now" process.
The Contract of Sale
The contract of sale is always between the purchaser and the artist and will be based on the information supplied by the artist.
Information about the Artwork and Artists
The information about an artwork and information about the Artist themselves is supplied by the Artist. Artwork International undertakes a quality review of the information supplied primarily to ensure that the content is not offensive and that the artwork fits the criteria for selection for the website.
We try to verify the information as best as we can but we are unable to warranty its accuracy.
Using the Bird Art International online payment system
All payments made through the Artwork International online payment system will automatically be handled as an Escrow style service. There are no additional charges to the purchaser for using a credit card.
What happens if two people try to buy the same artwork?
It is possible that two (or more) people both want the artwork at the same time and both use the online payments system to deposit money. It is up to the artist to decide who should have the artwork. All monies deposited by the unsuccessful purchaser will be returned as quickly as possible.
What happens if the sale goes wrong?
Although we hope that every buyer will be supremely happy with their purchase, occasionally things will not be as described or perhaps the artwork will arrive damaged.
As mentioned above the contract for sale is between the purchaser and the artist and it is these two parties who need to resolve the issue and sort out any insurance claim or refund as necessary.
If the payment has been made via the Escrow style service, the payment made by the buyer (less the postage amount which will already have been sent to the artist) will remain in the account until such time as the buyer says it can be released to the artist or the artist informs us to repay the money to the buyer.
Bird Art reserves the right to remove any Artist or Purchaser from its website should it feel it is necessary to do so.
About Copyright
Copyright in an Artwork usually remains with the Artist even after a painting has been sold. If a piece of art has been commissioned, often the copyright will go to the purchaser.
The owner of the copyright can usually assign it to another party as they see fit.
Copyright laws vary between countries and we would advise you to check with your lawyers over this issue if it is going to be important to you.
